TERMS OF TRADE

 

These terms and conditions apply to the use of this site. By using this site you, the customer, agrees to be bound by these terms and conditions.The terms of trade set out below govern all of the supplies of goods and services from Sewing Worx Ltd to you the Customer.

Sewing Worx Ltd presents all information on this site in good faith and believes it to be correct and accurate as presented to Sewing Worx Ltd upon submission.

Sewing Worx Ltd may in the future alter or amend the terms and conditions on this site. Any and all amendments and alterations will be effective immediately once an update is made. If you, the consumer, continue to use this site after any update or amendment you are deemed to still agree and to be bound by the altered and amended terms and conditions.

General
All prices are in $NZD and are subject to GST of 15%. Freight is additional and is subject to GST of 15%. All pricing shown here is from our Auckland warehouse

Payments and property
Unless we have agreed in writing to extend credit to you , you must pay for all goods in full before delivery or collection.

Where we have agreed to extend credit to you, you must pay in full, by the 20th day of the month following the date of invoice. Your payment is made only when funds have fully cleared through the banking system into our bank account. If you have not paid in full by the due date, we may charge you interest compounding monthly on the unpaid overdue balance at the rate of 5% per annum above the current overdraft rate charged by our bankers, and we may charge costs (including collection costs and legal costs on a solicitor-client basis) and suspend delivery of further goods or performance of further services until the account is paid.

Limitation of liability
Sewing Worx Ltd will not be liable for any losses of any kind or any delay in supplying goods or services which are caused by any act of God, natural disaster, flood or earthquake, strike, lockout, fire, war, civil commotion, network service failure, inability to obtain products or supplies or any other cause beyond its reasonable control. This also includes your reliance on any information that is contained within the site or that is accessed through this website. Any goods delivered by you to Sewing Worx Ltd for service or other reasons are held at your own risk while in our care, and we accept no liability for their loss or damage.

ONLINE STORE TERMS
Our store is hosted on Woo Commerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Online orders may be paid for by secure credit card transaction, internet banking or, if you hold an existing account with Sewing Worx Ltd , you may choose to pay on your account. Goods purchased online by Sewing Worx Ltd account holders will be invoiced in the usual manner. Sewing Worx Ltd reserve the right to amend pricing at any time, based on price increases/decreases set by the Supplier and fluctuations in currency on imported items.

We reserve the right to levy additional freight charges if you make an incorrect selection. We will process your order as soon as possible within standard business hours. Our freight rates include the packaging and preparation of your item. We will email you a confirmation once your order has been dispatched, including a tracking number, so please ensure you supply a physical address, such as a workplace, where there will be someone present to sign for your item during NZ Couriers weekday delivery hours. Deliveries to rural locations can add 2-3 days to the targeted delivery time.

Sewing Worx Ltd take no responsibility for delayed or non-delivery of products if you have given incorrect or incomplete details.

PRODUCTS
Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange according to our return policy.We have made every effort to display as accurately as possible the images of our products and we reserve the right to correct any errors, inaccuracies or omissions and to change or update information as required.

Modifucations to products and prices
All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of Sewing Worx Ltd. We reserve the right to revise or discontinue any product at any time.

Misinterpretation: If you are uncertain as to whether an item will be suitable for your needs or type of usage, please contact us before purchasing It is the responsibility of the customer to ensure the item they purchase will suit their needs.

Needles: If you have purchased needles please insure you have advised which sizes you require after purchase if you do not Sewing Worx Ltd will send either a mixture or what we think is best suited for the normal user.

Tax/GST Invoices: We are GST registered and invoices are provided on request.

Refund
If you wish to cancel your order please e-mail us at [email protected] at your earliest convenience. If your order has been shipped you are responsible for shipping the goods back to us and the goods must be in the same packaging and condition as it was sent in. Refunds will be credited against your original method of payment, e.g. to the credit card you used to make the purchase. Please choose carefully. If you have any questions about a product please contact us before purchasing, we would be happy to answer any questions you may have about the specifications or capabilities of the product. We offer a 14 day refund period for a change of mind provided that the following conditions are met. Returned goods must be unused, in original and unopened packaging and in saleable condition. We accept refunds and exchanges on regular items. Sale items cannot be refunded. Goods are not sold on a trial basis and we reserve the right to deduct an admin fee. If your order cannot be fulfilled for whatever reason, you will be offered an alternative or given a full refund. Unless agreed otherwise in advance, the return of goods is at your cost and risk. You will be responsible for paying for your own shipping costs to return your item. You should consider using a trackable shipping service as we do not guarantee that we will receive your returned item. Unfortunately we are unable to issue a refund if the item has been damaged en route to us. The item must be returned to us within 14 days from the date of purchase.

Exchanges
If a product is found to be defective, we will send a replacement within 14 days or as soon as that product becomes available. If you need to exchange it for the same item, send us an email at [email protected] and courier your item to 322 Jackson St, Petone, Lower Hut 5012

Return shipping
To return your product, you should courier your product to: 322 Jackson St, Petone, Lower Hut 5012. You will be responsible for paying for your own shipping costs to return your item. You are encouraged to use a trackable shipping service as we do not guarantee that we will receive your returned item.

Damage in Transit
If your order is received damaged you must contact us within 48 hours so that we can initiate a claim with the freight company. Unfortunately we cannot accept claims for damage outside of this time period.

Delivery and risk
Unless free shipping is stated the customer shall pay for all shipping and handling charges. You are responsible for risk in the goods from the time they are received by a carrier for delivery to you, or the time they are received by you or your agent. Standard processing time is 1-3 Business Days from when payment has been received. Delivery timeframe is approximately 1-5 business days after funds clear into our bank account. If there is any delay you will be notified by email once we have sighted your order and will offer a refund if there is a lengthy delay. Sewing Worx Ltd may at its discretion, deliver the products by instalments in any sequence. Any dates quoted by Sewing Worx Ltd for the delivery of the products are approximates only gathered from the courier company used and shall not form part of the Contract. Sewing Worx Ltd shall not be liable for any delay in delivery of the products whatsoever caused. Unless the customer notifies Sewing Worx Ltd differently on the day of delivery (this notification must be confirmed in writing within two days) the Products will be deemed to have been accepted by the customer as being in good condition and in accordance with the Contract.

Faulty Goods
Sewing Worx Ltd is subject to the Consumer Guarantees Act 1993. New products purchased under these Terms and Conditions directly from Sewing Worx Ltd by an end-user customer may be returned by the customer up to fourteen (14) days from the date of shipment for a replacement. In the event that goods have a fault, we will repair the fault. If this is not possible, we will replace the goods and only in the case that we cannot get a replacement, will the customer be given a refund. Refunds will only be given if you meet the terms of our refund policy.

Warranty
Where the Consumer Guarantees Act applies to the supply of goods or services under these terms of trade, you may have additional rights under that Act.
Sewing Worx Limited warrants that it will replace, or at its option repair, goods supplied under this agreement which are accepted as defective, provided that you notify Sewing Worx Limited in writing of any defect within 14 days of delivery. The same process as faulty goods claims applies to warranty claims i.e. order of repair/replace/refund. The warranty period begins on the date goods are received. The Warranty provided by Sewing Worx Ltd does not cover damage, fault, failure or malfunction due to external causes, including accident, abuse, misuse, courier, problems with electrical power, servicing not authorised by Sewing Worx Ltd, usage and/or storage and/or installation not in accordance with product instructions, normal wear and tear, act of God, fire, flood, war, act of violence or any similar occurrence; any attempt by any person other than Sewing Worx Ltd personnel or any person authorised by Sewing Worx Ltd, to adjust, repair or support the products supplied by Sewing Worx Ltd. Any service response times stated by in the service contracts are approximate only and Sewing Worx Ltd shall not be liable for any direct or indirect loss or damage arising from its failure to meet such response times, howsoever occasioned.

Troubleshooting: Sewing Worx Ltd will provide general advice and technical assistance to the customer in accordance with the then-current service and technical support policies in effect. Service and support offerings may vary from product to product.
